By accessing or using our website, services, or entering into any transaction on the platform, you agree to be bound by the following Terms and Conditions (“Terms”). 1. Definitions
- “Platform” means www.swabhimaan.co.in and all associated services.
- “Buyer” / “User” refers to any individual or entity that uses the platform to explore, book, or purchase services, including stays, tours, products, and support services.
- “Seller” / “Host” refers to any individual or entity listing property, tours, products, or services on the platform including assisted care facilities, travel operators, and rental hosts.
- “Services” includes but is not limited to short-term and long-term senior housing, assisted living, travel and tourism packages, recovery centers, wellness products, and related support systems.
2. Eligibility
- You must be 18 years or older and capable of entering into a legally binding contract under Indian law to use this platform.
- By using the platform, you represent and warrant that you meet all eligibility criteria and agree to comply with these Terms.
3. Platform Role and Responsibility
Swabhimaan acts as an aggregator and facilitator between Buyers and Sellers. While we strive to ensure quality and reliability:
- Swabhimaan does not own or operate the listed properties or services unless expressly mentioned.
- Swabhimaan is not responsible for the acts or omissions of Sellers or the quality of the services provided.
- All transactions are at the sole discretion and risk of the Buyer and Seller.
4. Responsibilities of Sellers
By registering and listing on the Platform, Sellers agree to:
- Provide accurate, updated, and complete information about the properties/services offered.
- Maintain legal ownership or management rights over the property or service listed.
- Ensure compliance with applicable Indian laws, including health, safety, fire, and real estate regulations.
- Provide timely services as per listing details and resolve buyer complaints promptly.
- Not engage in false advertising, misrepresentation, or fraudulent activities.
- Ensure all staff and caregivers are adequately trained and screened (where applicable).
Swabhimaan reserves the right to suspend or terminate any Seller account for breach of these terms or on receiving serious complaints.
5. Responsibilities of Buyers
Buyers agree to:
- Provide true and complete information while booking or transacting on the platform.
- Abide by the terms of stay or service usage as listed by the Seller.
- Respect the rules, regulations, and culture of the properties or services availed.
- Make timely payments and not misuse, damage, or disrespect the services or property.
Swabhimaan reserves the right to refuse service or terminate access to Buyers found violating these terms.
6. Booking and Payments
- All bookings must be made through the platform or authorized channels.
- Payments are collected either directly by the Seller or through Swabhimaan’s integrated payment gateways.
- Swabhimaan may charge a service or convenience fee, which will be disclosed before transaction completion.
- In case of cancellation, refunds (if applicable) are governed by the specific cancellation and refund policies of each Seller.
7. Dispute Resolution
- Any dispute between Buyer and Seller must be initially resolved amicably between the parties.
- Swabhimaan may act as a facilitator or mediator, but is not liable for dispute outcomes unless the issue arises directly from Swabhimaan’s misconduct.
- Disputes involving Swabhimaan shall be governed by the laws of India and subject to jurisdiction of courts in Mumbai, India.
8. Limitation of Liability
To the maximum extent permitted by law:
- Swabhimaan shall not be liable for indirect, incidental, or consequential damages arising out of service usage.
- Liability is limited to the amount paid by the Buyer to Swabhimaan for the particular service in question.
9. Termination and Suspension
Swabhimaan may suspend or terminate any user or seller account without prior notice if:
- There’s a breach of these terms.
- Fraudulent or illegal activity is suspected.
- Continuation of services harms the platform’s reputation or users.
10. Intellectual Property
All content, design, logo, and proprietary materials on the platform are the intellectual property of Swabhimaan Eldertech Private Limited and may not be used without written consent.
11. Privacy Policy
All personal data collected is governed by our Privacy Policy and compliant with applicable Indian data protection laws.
12. Amendments
Swabhimaan reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform and shall be binding from the date of publication.
13. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the competent courts of Mumbi, India.
